ALTR TERMS OF SERVICE

Welcome to ALTR. These Terms of Service govern your access to and use of all services, platforms, and experiences provided by ALTR (“we,” “us,” or “our”). Please read these Terms carefully before using our Services.
1. Acceptance of Terms
By accessing or using the ALTR website (www.altrfit.com), mobile applications, booking platform, in-studio services, livestream sessions, or any other services provided by ALTR (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Services.
ALTR reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age to create an account, purchase sessions, or participate in ALTR workouts. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
To book sessions, purchase packages, or access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account.
ALTR reserves the right to suspend or terminate any account that violates these Terms or is used for unauthorized purposes.
4. Services Description
ALTR offers functional, full-body fitness sessions combining high-intensity interval training and strength work. Sessions are available in two formats:
Session schedules, formats, instructors, and availability are subject to change at ALTR’s discretion without prior notice.
5. Booking, Pricing, and Payments
Session packages, memberships, and drop-in pricing are listed on the ALTR website and booking platform. All prices are in U.S. dollars and are subject to change. Applicable taxes may be added at checkout.
By purchasing a session package or membership, you authorize ALTR or its payment processor to charge your selected payment method. All purchases are final unless otherwise stated in ALTR’s cancellation or refund policy.
Session credits may have expiration dates as specified at the time of purchase. Expired credits are non-refundable and non-transferable.
6. Cancellation and No-Show Policy
ALTR requires advance notice for session cancellations. Specific cancellation windows and any associated penalties (such as forfeiture of a session credit) will be communicated at the time of booking or on the ALTR booking platform.
Repeated no-shows or late cancellations may result in restrictions on future bookings at ALTR’s discretion.
7. Health, Safety, and Assumption of Risk
Participation in ALTR fitness sessions involves physical activity that carries inherent risks, including but not limited to muscle strains, sprains, fractures, cardiovascular events, and other injuries. By participating, you acknowledge and voluntarily assume all such risks.
You represent that you are physically fit and have no medical condition that would prevent your safe participation. ALTR strongly recommends consulting a physician before beginning any fitness program. You agree to inform your instructor of any injuries, health conditions, or physical limitations before each session.
ALTR is not responsible for any injury, illness, or damage arising from your participation in the Services, except to the extent caused by ALTR’s gross negligence or willful misconduct.
8. Code of Conduct
ALTR is committed to maintaining a welcoming, inclusive, and safe environment for all members and staff. You agree to:
ALTR reserves the right to remove any individual from a session or revoke membership at its sole discretion for violations of this Code of Conduct.
9. Intellectual Property
All content on the ALTR website and within the Services—including but not limited to text, graphics, logos, images, video, audio, workout programming, and software—is the property of ALTR or its licensors and is protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any ALTR content without prior written permission. Recording of livestream or in-studio sessions is prohibited unless expressly authorized by ALTR.
10. Privacy
Your use of the Services is also governed by ALTR’s Privacy Policy, available at www.altrfit.com/privacy-policy. By using the Services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
11. Third-Party Services and Links
The Services may contain links to third-party websites or integrate with third-party platforms (such as payment processors or video conferencing tools). ALTR is not responsible for the content, practices, or policies of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALTR DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALTR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
ALTR’S TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO ALTR IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless ALTR and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict-of-law principles. Any disputes arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota.
16. Termination
ALTR may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will remain in effect.
17. Miscellaneous
Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ALTR regarding the Services.
Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. ALTR’s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without ALTR’s prior written consent. ALTR may assign its rights freely.
